Police ranked 2nd worst in survey; Bt5 bn bribes paid to 10 govt agencies
The Land office is the most corrupt agency in the Thai bureaucracy, while police are ranked second in this dubious list where households needed to make illegal payments to facilitate their service, according to an academic survey.
The survey titled "Corruption in the Thai Bureaucracy in 2014: A Survey of Attitudes and Experiences of Heads of Households" by Chulalongkorn University's Pasuk Phongpaichit found that 7.2 per cent of 6,048 heads of Thai households said they were asked for a bribe by officials at land offices whenever contacted for a service, while 6.1 per cent said police personnel asked for money from them.
Land offices, which come under the Department of Lands, are the key agency for all transactions and documentation involving sale or purchase of land. The office is authorised to charge a fee but officials demand extra money to speed up work or legalise some grey documents, the survey revealed.
The Departments of Customs and Land Transport also took bribes, but only 2.4 and 1.9 per cent respectively of households in the survey said they needed to offer bribes to officials for their services, Pasuk said.
However, on a relatively positive note, she said the percentage of respondents who said they had to pay tea money to officials at the land offices, police, Customs and Transport departments had decreased from 12.3 per cent, 8.5 per cent, 10.3 per cent and 7.7 per cent respectively, in the previous survey in 1999.
The survey also revealed that the land office was the only bribe-taking agency in the bureaucracy that demanded more than Bt100,000 per head on average, Pasuk said. The police as well as the departments of Customs and Revenue also charge big amounts but the bribes average between Bt10,000 and Bt100,000, she said.
Public schools and local administrative organisations have also been pointed to as taking bribes from households, she said.
Officials at public schools seek bribes averaging Bt11,796 each time they are contacted for service, the Department of Customs demands an average of Bt10,538, the land-office bribes average Bt5,341, and police take Bt4,919 on average from each household, she said. Local administrations demanded only Bt1,000 on average, she said.
The survey estimated that total bribes taken by the land offices this year amounted to Bt1.9 billion, the police Bt1.7 billion and public schools Bt640 million, she said. Overall, Thai households paid bribes of Bt4.9 billion to 10 government agencies, according to the survey this year. However, she noted the amount was three times less than the last survey in 1999.
"Thai households in the survey gave importance to the problem of corruption but did not consider it more important than their own economic and income difficulties.
"Corruption is a chronic problem in the country and Thai households are less trustful of the media, the judiciary and the bureaucracy on this issue.
"Most of the survey respondents said they wanted to see tough punishment for corrupt officials and wanted the government to give priority to anti-corruption measures more than other issues," she said.
Department of Lands deputy director-general Wanit Intarak said the department was aware of the bad reputation of the land offices because of the bribery. It is difficult for the department to control as many as 800 offices and units under its jurisdiction, he said. "But we have inspected and boosted ethics and morality among officials to prevent corruption. We also use information technology in the management system to limit the opportunity for officials to take bribes."
Pol Colonel Mongkol Ketphan of the national police office said the Royal Thai Police had opened channels for people to lodge complaints on the work of the police to eliminate corruption from police stations. |

Ei tietenkään pitäisi verrata, mutta kyllä tuo yrittäminen on jo lähtökohtaisesti Suomessakin tehty hyvin vaikeaksi, pykäläviidakko on aika hirveä.

Mielenkiintoista, että ulkomaalaiset usein kokevat yrittämisen Suomessa helpommaksi kuin kotimaassaan. Ilmeisesti monien maiden lakiviidakot eivät ole alkuunkaan toiminnassa ja hommat jäävät mielivaltaisten byrokraattien päätösten alaisiksi. Olen spiigelin kanssa samaa mieltä, että ei se Suomessakaan helppoa ole mutta ilmeisesti monessa muussa maassa vieläkin vaikeampaa.

Gulerin mukaan Suomessa on hyvä yrittää.
– Turkissa on minusta vaikeampaa yrittää kuin Suomessa. Suomessa on vaikea aloittaa, mutta sen jälkeen kaikki on helppoa. Jos liike menee hyvin, niin sitten ei ole vaikeaa, Guler sanoo.
Pankki ei antanut lainaa
Gulerin alkuvaikeudet voi ymmärtää. Suomessa tarjotaan paljon tukea juuri aloittaville yrittäjille, mutta esimerkiksi lainaa tuntemattomalle ulkomaalaiselle yrittäjälle pankista ei herunut.
– Aloitin omalla rahalla, koska pankki ei antanut rahaa. Nyt on helppoa, kun liike on pyörinyt jo kolme vuotta ja pankki uskoo sinua ja antaa lainaa.
Gulerilla on neljä työntekijää ja laajennuksen myötä tulee vielä neljä lisää. Kokemusta on siis myös työvoiman palkkaamisesta Suomessa.
Miten hän suhtautuu suomalaisten yrittäjien ikuisiin valituksen aiheisiin sääntelyyn, byrokratiaan, työvoiman palkkaamisen kalleuteen ja sosiaalikuluihin.
– Kaikki tuo on Turkissa vaikeampaa, Guler sanoo.
Hän huomauttaa, että Suomessa säännöt toimivat ja korruptio ei ole samanlainen ongelma kuin Turkissa.
Työvoimakustannukset kohtuulliset Suomessa
Lappeenrannan teknillisestä yliopistosta valmistunut kiinalainen Xing Shillä on osakkaana kolmessa yrityksessä Suomessa: Easy China on konsulttiyritys, NordicSetGreen vie suomalaista ympäristöteknologiaa Kiinaan ja China Liangtse Wellness on kiinalainen hoitola Lappeenrannassa.
Shi on aikaisemmin toiminut usean vuoden ajan yksityisyrittäjänä Shanghaissa Kiinassa. Shin mukaan ainakin tuolloin vasta kehittymässä ollut sääntely oli riski yrittäjälle.
Suomessa sen sijaan säännöt ovat selvät.
– Suomessa sääntely on jo valmista. Se auttaa minua liiketoiminnassani, koska minun pitää vain noudattaa sääntöjä ja kaikki menee hyvin, Shi sanoo.
Kiinalaisen yrittäjän mukaan edes työvoimakustannukset eivät Suomessa ole enää niin hirvittävät Kiinaan verrattuna.
– Työvoimakustannukset ovat nousseet erittäin paljon Kiinassa. Tilanne on nyt ihan toinen kuin aikaisemmin. Työvoimakustannukset Suomessa ovat tähän verrattuna mielestäni kohtuullisella tasolla. |

Police have found billions of baht worth of assets at the home of Central Investigation Bureau commander Lt-General Pongpat Chayaphan, who has been suspended from service after being charged with several crimes, including lese majeste, a police source said late yesterday.
Yesterday's search reportedly turned up cash in both Thai and US banknotes amounting to billions of baht, as well as gold bars, rare Buddha images and numerous amulets along with a large number of land title deeds.
Pongpat and six other policemen were being detained at seven metropolitan police stations as of last night, after they were all taken to Bangkok-based military barracks at around 1am yesterday for questioning.
Royal Thai Police spokesman Lt-General Prawut Thawornsiri said earlier that Pongpat and the six others had confessed to their crimes. Three civilians accused of similar crimes were on the run and were being pursued by police, he said.
The cases would be clarified further and in greater detail at a press conference, said Prawut, who is also an assistant national police chief.
Senior police have rarely been charged with lese majeste.

As for the death of Pol Colonel Akkharawut Limrat, Prawut said a certificate issued by coroners on Friday said he suffered a broken spine at chest level, which was caused by a fall. Akkharawut, transferred from a top position along with Pongpat, had attempted suicide on three occasions after his transfer, he said.
Akkharawut was cooperative and gave useful information to police, he said.
"After giving his statements, he jumped off a building to kill himself out of distress and fear for prosecution, he said, adding that the colonel left a suicide note. Pongpat, his deputy Maj-General Kowit Wongrungroj and Akkharawut were transferred to inactive posts in an urgent transfer order late on November 11.
A police notice on Friday details their alleged crimes and lists eight more people - five police and the three civilians. Akkharawut had not been charged with any offence. His death was made known via social media posts yesterday.
Crime Suppression Division commander Chaithat Bunkham was transferred on November 13 but he was not on the notice, which comprises 10 people in total.
Another transfer order issued on November 14 resulted in a police commander being assigned to replace Colonel Watcharaphol Thongluan, commander of the CSD's Subdivision 5. Watcharaphol is also not on the notice.
Others on the list were Marine Police commander Maj-General Bunsueb Phrai-thuen, Samut Sakhon immigration chief Colonel Kowit Muangnual, Snr Sgt Major Surasak Jan-ngoa and Snr Sgt Major Chattrin Laothong |

Five more caught in police graft scandal

Civilians detained for armed threat, criminal conspiracy, theft, restraint
FIVE civilians accused of involvement in the corruption scheme engulfing crime buster Pol Lt-General Pongpat Chayaphan have been apprehended and are going through the criminal process, National police chief Pol-General Somyot Poompanmoung said yesterday.
The five were identified as Nattapon, Sitthisak and Narong Akarapongpreecha, Sutthisak Sutthijit and Chakarn Phakphoom. They were wanted for armed intimidation, criminal conspiracy involving more than five offenders, restraint of freedom, and joint theft.
They are now in the custody of Phra Khanong police in Bangkok.
Somyot said more people involved in this scheme - he didn't specify the number - would be arrested if or when evidence implicating them became available.
Somyot had earlier dismissed as rumour unconfirmed news reports that some 40 senior police would soon be summonsed for alleged involvement with Pol Lt-General Pongpat Chayaphan, who is now in custody.
An investigation into this issue was underway. If or when the summonses were issued, it would be known publicly, he said, adding: "Don't play up this issue so frequently that it disturbs police and distracts them from their work."
One of the identified suspects, Nattapon, is a former Army major. Royal Thai Police spokesman Pol Lt-General Prawut Thawornsiri confirmed yesterday that Natthaphol had been stripped of his Army rank and was the same Natthapol among the new suspects in police custody.
Somyot, meanwhile, said he would welcome "tell-all revelations" by former Rak Prathet Thai Party leader Chuwit Kamolvisit about police corruption - if he could back up his claims with concrete evidence.
Speaking at a press conference before Somyot's remarks, Chuwit said the systematic corruption and fee collection engulfing the former Central Investigation Bureau commissioner involved many more officers apart from CIB deputy chief Pol Maj-General Kowit Wongrungroj and two non-commissioned officers, all of whom had been suspended and placed in custody.
Somyot later called on Chuwit to fully identify two bureau commissioners he referred to as 'Kor' and 'Jor', saying it would be easier for police to probe further into their alleged crimes cited by Chuwit.
In Chuwit's statement, he said a gambling den inside the Colonze massage parlour on Rama IX Road was operated by people who cited backing from the monarchy. This den generated large profits from gamblers and was able to pay a daily "protection fee" of Bt20 million to the police for nine months of operation in 2001, before it relocated to Soi Ratchadaphisek 18, the same year. It operated there for 24 days, starting August 1, before it closed down after being exposed by media reports.
He said Pongpat, as CIB chief at the time, was supposedly unable - under a police culture of corruption - to extract the fee from this den without knowledge and approval of the Metropolitan Police Bureau chief at the time.
Chuwit, however, praised Somyot, saying he believed the incumbent RTP commander was a good person who had good intent in tackling police corruption. The parlour tycoon-cum-politician said the information he released yesterday was based on a document he submitted to the RTP for further investigation. A finding later claimed that no involvement by police was found with this gambling den.

AMONG NUMEROUS ARTEFACTS found in the alleged secret treasure of police crime-buster Lt-General Pongpat Chayaphan are what appear to be an ancient deity image and many centuries-old Buddha images.
Fine Arts Department (FAD) director-general Bowornwej Rungrujee said yesterday that many of the statues and images were possibly brought to Thailand from a neighbouring country, as the department inventory showed that the same locally made items were all at their original places or museums.
He said the verification and authentication process of the approximately 30,000 items would begin on Monday and was expected to take about two months.
Private collectors were forbidden from owning many of the items, he said, adding that violators faced a maximum five-year prison term and/or a maximum fine of Bt500,000.
Requests to inspect the items to see if they had been stolen can be made at the FAD's office at the National Museum.
Certain items, if found to be authentic, might be returned their countries of origin.
Bowornwej said the items would be arranged in categories and protected by
various laws.
In the meantime, he said the items with less value would be kept at the FAD's warehouse in Pathum Thani, while items with high value would be held by the Metropolitan Police Bureau. They would be sorted according to their material, era or the year of their production, and paintings.
Bowornwej said FAD experts would be aided in the verification and authentication process by the Anti-Money Laundering Office, police and soldiers, all of whom would be issued ad hoc identity cards to discourage stealing and make tracing items easier if they were lost.
Police and soldiers yesterday raided an antique shop off Chaeng Wattana Road in northern Bangkok and seized a number of items suspected of being bought from Pongpat, the former Central Investigation Bureau chief. |

Korruptiosta kiinni jäänyt poliisipäällikkö tuntuu olleen monessa mukana. Nyt kaatuu isoja kihoja mutta poistuvatko ongelmat vai tuleeko näiden yrittäjien tilalle vain joku muu? Suommat ovat kuitenkin niin isoja, että varmaan halukkaita löytyy ottamaan ohjat.

Arrest warrants have been issued for three suspects, including two police, in connection with an online gambling organisation allegedly run by an Indian businessman with ties to ousted crime-buster Lt General Pongpat Chayaphan.
Pongpat, former commissioner of the Central Investigation Bureau, and his then deputy Pol Maj-General Kowit Wongrungroj were charged on Saturday for their alleged roles in the gambling operation run by Abubakar bin Sulaiman, National Police spokesman Lt-General Prawut Thawornsiri said yesterday.
Pongpat and Kowit are in custody at the Bangkok Remand Prison.
The Abubakar operation reaped around Bt100 million from Thai punters through online betting, and police have found that Pongpat and Kowit had benefited from it, he said.
The three other suspects were identified as Pol Colonel Worraphoj Pheutphol, Pol Lt-Colonel Songsak Khunsri and Withoon Trakarnphruek.
Pongpat reportedly led police in 2009 to arrest an Indian businessman in 2009 accused of involvement in an online gambling organisation with turnover of billions of baht.
Pongpat, then commander of the Crime Suppression Division, arrested property developer Karan Singh Thakral at a luxury condominium on Thong Lor Soi 3. Thakral was then charged with hosting Internet football gambling.
Pongpat, speaking in a press interview, said Thakral, 39, was part of the online gambling network of Abubakar bin Sulaiman.
The network's turnover is alleged to be more than Bt3.2 billion, with police suspecting that the enterprise was also involved in more unspecified illicit businesses. |

Jos ryhdytään puheista tekoihin ja alkavat karsia myös näitä paikallisia korruptiokeisareita, ollaan toki oikeilla jäljillä. Edelleen kuitenkin mietin, tuleeko tilalle vain uudet yrittäjät.

MANY OF the 8,000 local administrative bodies nationwide are hotbeds of graft and corruption, the Public Sector Anti-Corruption Commission said yesterday.
Prayong Preeyajit, chief of the PACC, said there was little oversight for local elected bodies and demands for bribes of Bt100,000 or a staff position was not unheard of.
Corruption in the public sector is incorrigible, he told a panel during the 13th National Symposium of Justice Administration at the Queen Sirikit Convention Centre in Bangkok.
"The mechanisms for dealing with the problem can't cope. Corruption floods in like water from a broken dam. It only stopped in May when the [National] Council for Peace and Order took over. But we can't be too sure even today," he said, referring to the military seizure of power. The PACC only had 247 staff and they could not keep up with the caseload, he said.
Today, businesspeople have to pay up to 30-40 per cent in kickbacks to win a concession from some local governments, he said. "In several areas, elections became a tool [for them] to come in to seek gains", he said.
An example was a futsal stadium at one local area that cost Bt180 million instead of Bt50 million, he said. A facilitation centre should be set up to assist the activities of various anti-corruption organisations, Prayong said.
Chairat Khanitbut, deputy secretary-general of the National Anti-Corruption Commission, said various sectors must work in tandem. Chairat said the NACC would from now on form a big team for big cases to speed up the time it takes to process them.
Pramon Sutheewong, chairman of the private-sector Anti-Corruption Organisation of Thailand, said he would consider it a success if the government could punish at least a few of the big guys within a year. "If you can't deal with big fish then they won't be afraid, because they might die before ever being prosecuted," he said |

Itse olen miettinyt koska tämä kenu (juntan päällikkö) joutuu ilmiantamaan omia kavereitaan? Eiköhän niissäkin ole samaa sakkia vaikkei ehkä niin anneta julkisuuteen. |

Four out of nine policemen report themselves to the Phaholyothin Police Station yesterday to face charges over allegations that they took bribes from a big online gambling operator.
Five more told to face charges, as Pongpat undergoes heart surgery
Four commissioned policemen yesterday turned themselves in to face charges related to claims they took bribes from an online gambling organisation.
A gambling network allegedly run by Abubakar bin Sulaiman is said to have links with ousted crime-buster Lt General Pongpat Chayaphan.
The four police were identified as Pol Lt Colonel Wattana Phon-ngarn-dee, Pol Major Apisit Mekprayoon, Captain Nitipat Kangruambut and Captain Sakkarin Kaysorntien.
"They are now charged with taking bribes and corrupt negligence," Metropolitan Police Division 2's deputy commander Pol Colonel Chayut Marayart said yesterday.
He oversees the investigation into alleged bribe taking by police who participated in a 2009 crackdown on the so-called Abubakar gang. Pongpat reportedly led police to arrest an Indian businessman here five years ago on suspicion that the suspect was involved in an online gambling organisation with turnover of billions of baht.
Chayut said all the four suspects who turned themselves in yesterday denied any wrongdoing.
Following their surrender, police took them to their homes to conduct searches. Police can detain the four suspects for 48 hours in line with the law, but further detention requires permission from a court.
Relatives of the men are plan to post bail for them.
These four police are among 14 suspects for whom arrest warrants were issued last Wednesday over charges related to the bribe taking scandal related to the Abubakar gang.
Nine of these suspects are police. They were told to report themselves by December 29 or face arrest.
An informed source said the Metropolitan Police Bureau chief had already contacted the supervisors of the other five wanted police suspects to arrange for their surrender.
In related news, Pongpat was transferred out of the Central Chest Institute yesterday back to the Medical Correctional Institution, where he underwent a "balloon" heart surgery on Saturday. When Pongpat was at the institute, there was huge police presence.
The transfer took place, after doctors agreed that Pongpat's health conditions were good enough.
Pongpat has been in detention since last month.
"He has records of high-blood pressure. But his chest pain was likely acute," Special Remand Prison chief Ayut Sintopphan said. |

Tämä on mielestäni hyvin mielenkiintoinen esitys ja toteutuessaan sekä oikein käytettynä se olisi hyvä keino taistelussa korruptiota vastaan. Tuossa on vain kaksi hankalaa asiaa eli "toteutuessaan" ja "oikein käytettynä".

New charter may let ordinary people go after 'wrong-doers' passed over by Parliament
The next constitution will empower voters to impeach politicians if they escape the claws of parliamentarians, chief charter writer Borwornsak Uwanno said yesterday.
The Constitution Drafting Committee chairman said the body would make provisions about the impeachment of politicians clearer and would empower voters to have the final say if the House of Representatives and the Senate failed to impeach people they believed had abused their offices.
He said the next charter would empower elected MPs and selected senators to impeach politicians who had committed wrongdoings. If they were impeached by parliamentarians, they would have to leave office and would be banned from holding political office for five years.
But if the Parliament voted not to impeach, voters would be able to make the final decision - and if the public voted to impeach a politician, he or she would be banned from politics for life.
"This idea is to return the power to the people," the CDC chairman said.
He noted that the Senate, which was empowered to impeach politicians by past constitutions, had only impeached then National Human Rights Commission member Jara Disthapichai.
Borwornsak said the next constitution would clarify the differentiation between impeachment processes against a serving politician and against someone who had left office. If someone were targeted while still serving, the charter would call it the "impeachment process for removing the politician from office". In the alternative case, the "impeachment process for depriving politicians of their political rights" would be used.
Borwornsak said these clear definitions would prevent disputes over whether someone who had left office could be impeached.
He said that so far the issue had been discussed only in principle and more talks were needed to iron out the details.
"For example, we will have yet to decide how many votes will be required for impeachment [and] which behaviour or actions will warrant such a process and how it should proceed," he said.
Borwornsak believes the impeachment process against former prime minister Yingluck Shinawatra will not affect the efforts of the Anek Laothamatas-chaired committee charged with studying reconciliation measures. He believes the panel's proposals will be supported by all sides.
"The outcome of the impeachment process [against Yingluck] by the National Legislative Assembly will set a precedence for all cases equally," he said. |
